Pg. 703 Beard “I’m going to go ahead and put that on the screen for us to go through. All right. Can you see that on your screen?” Kinder “Yes. This is the PowerPoint that I prepared for trial today.”
This is exactly what the Searfoss trial was reversed for yet Wood County went for it again. No evidence, just his PowerPoint.
Kinder “$1,200 was deposited into the PHCA KeyBank account ending in 2266, which is the medical clinic account, on 10/22. I was able to track that money. There was a $1,200 check within that same period that was deposited into Miss Koester’s Genoa Bank account as well.”
So here is incident 7 of what they accused Jason of. On or about October 22, 2012, Harold Jason Craig, did with the purpose to deprive the owner, PHCA, withdrew $1,200 from PHCA’s KeyBank account. The aforementioned conduct constituted and/or involved a violation of RC 2913.02(A), 2913.02(B), Theft, a felony of the fifth degree.
So, first, it was a deposit, and then a check was written. We are not trying to change the testimony’s meaning so maybe he just stated he could track it, but that it was still stolen. Pg. 719 Kinder “$1,200. The date of that check was 10/22 of 2012. Is as was written to Kristie Koestler. And you see a notation that says lawn equipment.” Pg. 786 Kinder “There was documentation for the $1,200 for lawn equipment to Ms. Koestler. The check was in there. But then many others were not.”
We have questions. No, we don’t, everyone has testified that PHCA had a lawn.
Here is an interesting Q&A with Kinder knowing what we know. Beard “And Mr. Kinder, you said you had went over what Ms. Clifton had given you. Did you specifically also go through the records themselves to verify?” Kinder “Yes. Part of the ethics of a certified fraud examiner, I have to make sure that what I’m testifying to is accurate. I would love to always rely on colleagues. But to be honest, humans make mistakes…” And then… Pg. 790 Beard “You’ve reviewed the meeting minutes?” Kinder “I won’t say I looked at every single one of them with great detail.” Then, Pg. 800 Defense Attorney Smith “You said you reviewed the minutes, maybe not super fine tooth comb, on every set of minutes?” Kinder “For the set of minutes that I received from the Attorney General’s Office, I don’t believe I read everything.”
You don’t say. Let’s point out a few things you missed. The September 2012 Minutes state that committees will receive 10% of donations. Committees are Beautification and Safety, Education and Programming, Medical Clinic, and Festival. These coincidentally match the bank accounts; even the “hidden” medical clinic account that Stephanie Serda opened but testified to not knowing it existed.
In the first link, she says she is a signer, in the second, she doesn’t know about the account. Amazing!
