Post 44 – Trial – Douglas Kinder (part 1)

We have theories about this witness. Let’s call them options. Option #1 is that he has absolutely no clue what he is doing. Option #2, he just chose to lie. Option #3, he found out after receiving more info from the Attorney General in October 2019 that Jason was innocent, but his office refused to admit they were wrong.

Here is what happened. Ashley Clifton put together a spreadsheet of questionable figures amounting to $238,000. Remember in her testimony she actually states several times that these transactions are more than just some she could not verify, they were ones she could not categorize or she did not feel furthered the mission of the PHCA.

You will see testimony from Kinder that says he verified expenses that the State used as specific examples of theft.

He did not attempt to verify anything from Ashley Clifton. He just charged Jason with everything she had on paper. Here is the real corruption that we find extremely calculated and corrupt. He testifies at length about what he cannot verify. You will see he states he could not track where the money was going that was put in Kristie’s account. He created a spreadsheet that said he didn’t know where the money went, but the actual bank records never made it to court. This was a move that Wood County historically made. Right before Jason went to trial, a conviction was reversed for Kinder doing the exact same thing. He was lazy and Jason paid for it.

In State v. Searfoss, the Sixth District Court of Appeals reversed Searfoss‘ conviction due to Douglas Kinder testifying by PowerPoint. In Jason’s case, they did not have a problem with him testifying by PowerPoint. Did the corruption make it all the way to the Appeals Court? We are hoping not, but you will see that they tend to contradict themselves a lot in their decisions. This tactic seems to be standard operating procedure in the Wood County Prosecutor’s Office where Tom Matuszak made a career out of being crooked according to a December 2023 multi-journalistic investigation by NPR.

You will also see a lot of simple lies that Kinder tells. Visalus went online after April 2013. We have the records that show different. He will verify a larger amount of transactions and said he gave Jason the benefit of the doubt. However, many are specifically listed as thefts and all of them are on Ashley Clifton’s list that he did not verify. Charging Jason with stealing over $30,000 that was used for postage to mail Visalus was an interesting accusation that the Prosecutor puts in the jury instructions. They say the money was transferred to other accounts. PayPal is extremely detailed about where money is sent. This was simply a lie. There were six hours of testimony and we are just going to show just a small piece of the testimony that proves he was either corrupt or had no clue what was happening. We bet on corruption.
