Post 39 – Trial – Kristie Koester (part 6)

Jason believed in going big or going home. Kristie supported him pretty much in his missions. He was overly competitive and wanted his babies to always be happy. When the school would have classroom canned food drives, Jason would wait until the last day of the contest and go and buy a truckload of canned foods just so the girls could feel good and be proud of their dad. This went on for years. Jason and Kristie loved all of the girls’ little friends and Kristie ended up running a Girl Scout troop. Jason, in his infinite competitiveness, decided he wanted the troop to win all the prizes so he talked Kristie into ordering 2,500 boxes of cookies for $12,500. It actually worked out because they sold them all. Here is some testimony.

Smith “Can you walk me through, for example, walk me through anything that you and Jason were involved in or things that Jason was involved in that involved purchasing on a large scale Girl Scout Cookies, for example.” Koester “I was a Girl Scout leader.” Smith “Would you buy large amounts of Girl Scout cookies or large amounts up front?” Koester “Anything you had left you had to purchase.” Smith “Where would you and the girls sell those?” Koester “We had different locations that we would go set up booths, and sell through the neighborhood, family, and friends.” Smith “So it was more than just your girls knocking on doors saying would you like to purchase cookies?” Koester “No, we would go to different businesses and set up booths.” Smith “And you already had those cookies?” Koester “Yes.” Smith “And how did people pay for those cookies?” Koester “Cash, check.” Smith “If they paid cash, where did that cash go?” Koester “Into the bank.” Smith “That would be a cash deposit?” Koester “Yes.” Pg. 623 Smith “Okay. Now, was there times you pre-signed checks?” Koester “Yes.” Smith “Then ultimately then Jason would fill them out purchasing various things?” Koester “Yes.” Smith “So that would be a very real explanation as to why someone else is filling out a check that you signed?” Koester “Yes.”
